Terms of Use

1. Agreement

These Terms of Use (“Terms”) are the end user licence agreement between you and Trippy Cosmos Ltd, a company incorporated in the United Kingdom, company number [PLACEHOLDER: company number], registered office [PLACEHOLDER: registered office address] (“we”, “us”), for the iOS app Soulfeed: Spiritual Teachings (“Soulfeed” or “the app”). By downloading or using the app you agree to these Terms. If you do not agree, please do not use the app.

Your use of the app is also subject to Apple’s Licensed Application End User License Agreement (the “Standard EULA”) and the Apple Media Services Terms. Where these Terms and the Standard EULA differ, these Terms apply to the extent permitted by Apple’s rules, and the Standard EULA applies to everything these Terms do not cover. Our Privacy Policy explains how data is handled.

2. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms, for your own non-commercial use. You may not copy, modify, distribute, sell, rent or reverse engineer the app except where the law allows this despite these Terms.

3. Soulfeed Premium subscriptions and free trials

Soulfeed is free to download. Full access to the app’s features and content is offered through an auto-renewing subscription, Soulfeed Premium, available as an annual plan (which may include a 7-day free trial for eligible new subscribers) and a monthly plan. What each plan includes, its length and its price in your local currency are shown in the app and on the App Store before you buy. Prices may vary by country and may change; any price change is handled by Apple, which will notify you where required.

  • Payment. Payment is charged to your Apple ID account when you confirm the purchase, or, if you start a free trial, when the trial ends.
  • Automatic renewal. Your subscription renews automatically for the same period and price unless you cancel it at least 24 hours before the end of the current period.
  • Renewal charge. Your account is charged for renewal within 24 hours before the end of the current period.
  • Managing your subscription. You can manage or cancel your subscription and turn off auto-renewal in your Apple ID account settings at any time after purchase (on iPhone: Settings › your name › Subscriptions).
  • Free trials. If a free trial is offered, it converts into a paid subscription when it ends unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
  • Restoring purchases. If you reinstall the app or move to a new iPhone, use Restore Purchases in the app while signed in with the same Apple ID.

4. Cancelling and refunds

Cancelling stops future renewals; you keep access until the end of the period you have paid for. Deleting the app does not cancel a subscription. Purchases are processed by Apple, so we cannot issue refunds ourselves. To request a refund, visit reportaproblem.apple.com or contact Apple Support. Refunds are granted under Apple’s policies and any rights you have under consumer law.

5. The content

The app contains historical spiritual and philosophical texts in public-domain translations, together with modern renderings, explanations, reading plans, reflection questions and other commentary written by us. The public-domain source texts remain free for everyone to use. Our modern renderings, commentary, selections, arrangement and design are protected by copyright and owned by Trippy Cosmos Ltd.

Some content summarises the ideas of modern teachers in our own words. These summaries are our interpretation; they are not quotations, and they are not written, endorsed or approved by the teachers named. We work to keep translations, attributions and explanations accurate, but we cannot guarantee that every detail is free from error. If you spot a mistake, please tell us.

6. Not religious, medical or psychological advice

Soulfeed is for personal reflection and learning. It does not provide religious instruction, medical, psychological, therapeutic, legal or financial advice, and it is not a substitute for a qualified professional. If you are struggling with your mental health or are in crisis, please contact a medical professional or your local emergency services.

7. Acceptable use

You agree not to use the app in a way that breaks the law, infringes anyone’s rights, or interferes with the app’s operation, and not to copy or extract our commentary or the app’s content in bulk for commercial use. Sharing individual passages with friends using the app’s share features is welcome.

8. Intellectual property

The app, the Soulfeed name and logo, and all content other than the public-domain source texts are owned by or licensed to Trippy Cosmos Ltd. These Terms do not give you any rights to our trade marks. The fonts used are licensed under the SIL Open Font License.

9. Terms required by Apple

  • These Terms are between you and Trippy Cosmos Ltd only, not Apple. We, not Apple, are solely responsible for the app and its content.
  • Apple has no obligation to provide any maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
  • We, not Apple, are responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection or similar laws.
  • If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.

10. Warranty and liability

If you are a consumer, you have legal rights in relation to digital content that is faulty or not as described, and nothing in these Terms affects those rights. Subject to that, the app is provided “as is” and we do not promise that it will always be available, uninterrupted or error-free.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. Subject to that, we are not liable for losses that were not foreseeable when you agreed to these Terms, for business losses, or for loss of data that you could have avoided, for example by keeping iCloud sync turned on. Where we are liable, our total liability to you is limited to the amount you paid for the app and subscriptions in the twelve months before the claim.

11. Ending these terms

You can stop using the app at any time by deleting it (remember to cancel any subscription separately in your Apple ID settings). We may suspend or end your licence if you seriously break these Terms. When the licence ends you must stop using the app; sections 5 to 10 and 13 continue to apply.

12. Changes to these terms

We may update these Terms, for example to reflect new features or changes in the law. We will post the new version here and change the effective date above, and for significant changes we will let you know in the app. If you keep using the app after a change takes effect, the updated Terms apply.

13. Governing law

These Terms are governed by the laws of England and Wales [PLACEHOLDER: confirm], and the courts of England and Wales have jurisdiction. If you live in Scotland, Northern Ireland or elsewhere in the UK or EU, you may also bring proceedings in your local courts and you keep the protection of the mandatory consumer laws where you live.
